Terms of Service
This English version is provided for your convenience. SuperOvni Studios is based in Mexico, so if there's ever a conflict between the two versions, the Spanish version prevails to the extent permitted by law.
These Terms are the agreement between you and SuperOvni Studios for playing Go, Capy, Go! They're written to be understood; if anything isn't clear, email us at hola@superovni.com.
1. Who we are
Go, Capy, Go! is a video game created and operated by SuperOvni Studios, based in Saltillo, Coahuila, Mexico ("we" or "us"). Contact: hola@superovni.com. Details about the data controller are in the Privacy Policy.
2. Acceptance
By playing Go, Capy, Go! you accept these Terms, the Privacy Policy, the Cookie Policy, the Fair Play Rules and the Important Notices. If you don't agree, please don't use the game.
3. The game
- Go, Capy, Go! is a game about launching a capybara and making it fly, played in the browser or installed as an app (PWA). It's free and fully playable without paying. It has an optional Shop of cosmetic items for real money (section 7); no subscriptions or ads.
- We may add, change or remove features, inventions, upgrades, in-game prices, weather, events and balance rules to keep it fun and fair.
- Some things depend partly on chance (for example the weather, which animals appear, or a visit from the UFO) and may change.
- Ranking and friends. If you have an account, your flights count toward the global ranking (weekly and all-time). There and with your friends we show your pilot name, your badge and your records (distance, speed, height and acceleration); never your email. Pick a pilot name that isn't your full real name or offensive; we may change it or remove impossible or cheated results. Friendships are created with your code or link and you can remove them anytime.
4. Your account and progress
- You can play without an account: your progress (records, leaves, inventions, badges and settings) is saved only on your device. Without an account, if you clear your browser data, uninstall the app or switch devices, you may lose it and we can't recover it.
- To save your progress to the cloud and play on several devices, you can create an account with an email and password in Profile → Account. You must use an email that's yours, confirm it and keep your password safe.
- An account is personal: one person, one account. Don't sell, lend or share it.
5. Minors
Go, Capy, Go! is suitable for all ages: it has no chat or ads, and asks for no data to play. The whole game is free; the accessory Shop is optional and paid with real money. If you're under 18 you need permission from a parent or guardian to create an account and to buy; if you're under 13, ask them to create it with their own email. Without an account you can play without giving us any data. If you're a parent or guardian, read the Parents' Guide.
6. Leaves, inventions and in-game items
- Leaves, turbo charges, inventions, upgrades, badges and any other in-game items are virtual: they're earned by playing, they aren't money, they have no value outside the game and they can't be exchanged, sold or transferred for real money or goods.
- We grant you a personal, limited and revocable license to use them within the game. You don't own them.
- We may adjust their amounts, prices or behavior to keep the game balanced, and correct results obtained through bugs or cheating.
7. Shop: real-money purchases
- What you buy. Digital cosmetic items (accessories and costumes) that only change how your capybara looks. They give no advantage in the game. There are no loot boxes: you always know exactly what you're buying.
- Price and payment. The price is shown in Mexican pesos, taxes included, before you pay. On the web, payment is processed by Mercado Pago; in the Android app, by Google Play. We never see or store your card details.
- Delivery. You need an account to buy. The item is added to your account as soon as the payment is confirmed (usually seconds; you pay by card or with a Mercado Pago account) and you can use it on any device where you sign in.
- License. What you buy is a personal, non-transferable license to use the item in the game. It can't be sold, gifted, exchanged for money or moved to another account.
- Cancellations and refunds. Because it's digital content delivered immediately at your request, once delivered it can't be cancelled, except as provided by Mexico's Federal Consumer Protection Law. If you were charged and didn't get the item, were charged twice, or the item doesn't work, email hola@superovni.com within 30 days and we'll fix it (deliver it or refund you). Google Play purchases are also governed by Google Play's refund policies. You can also contact Mexico's consumer protection agency (Profeco).
- Minors need permission from a parent or guardian to buy.
- If you delete your account you lose the items you bought, and that doesn't entitle you to a refund. If we ever stopped running the game, we'd give at least 30 days' notice.
- Invoices. If you need a tax invoice, email us your details within the same month as the purchase.
8. Conduct
You agree to play fair. Among other things, you may not: use cheats, bots or programs that alter the game or your results; exploit bugs instead of reporting them; attack, overload or try to access our systems without permission; impersonate others; or use offensive names. Details are in the Fair Play Rules.
9. Your pilot name
The pilot name you type in your Profile is saved on your device. Once rankings or friends exist, that name and your badge may be shown to other players; you keep your rights to it and give us a free, worldwide, non-exclusive permission to display it within the game. We may change or remove names that break these rules.
10. Intellectual property
Go, Capy, Go!, SuperOvni Studios, their names, logos, the capybara character, designs, 3D models, sounds, texts and code belong to SuperOvni Studios or its licensors and are protected by copyright and industrial property laws. Nothing in these Terms transfers those rights to you. See Copyright and the Brand & Fan Content Policy.
11. Communications
If you create an account, we'll send you only the messages the service needs, from no-reply@superovni.com: confirming your account, resetting your password, or notices about important changes to these documents. We don't send advertising today; if we ever do, it will only be with your permission and you'll be able to unsubscribe.
12. Suspension
We may warn you, reset results, remove you from rankings or suspend your access if you break these Terms or the Fair Play Rules, or if it's necessary to protect other players or the game. If you think it was a mistake, email us at hola@superovni.com.
13. Warranties and liability
Go, Capy, Go! is provided "as is" and "as available". To the extent permitted by law, we don't guarantee that it will work without interruptions or errors, and we're not liable for lost progress or virtual items. What happens in the game is fiction: don't try it in real life (see Important Notices). Nothing here limits any consumer rights under the laws of your country that can't be waived.
14. Deleting your account
You can delete your account and all your data at any time from Profile → Account → Delete my account, or by emailing us. If you play without an account, delete your progress in Settings → Delete my data on this device. See How to Delete Your Account and Data.
15. Changes to these Terms
We may update these Terms. If a change is important, we'll let you know in the game before it takes effect. If you keep playing afterwards, you accept the new version; if you don't agree, you can stop playing and delete your data.
16. Governing law
These Terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Saltillo, Coahuila, unless the consumer protection law that applies to you gives you the right to go to the courts where you live. If you live in Mexico you may also contact the Federal Consumer Protection Agency (PROFECO).
